The criminal trespass won't hold water.  She let him in........twice (if you know what I mean).  He should be charged with adultery.  Is that even a PL charge in NY ?

It's a PL misdemeanor but no DA in NY has ever charged anyone with it. We're directed not to enforce it. I suspect it's solely on the books for divorce court judges to hold somebody responsible for during civil proceedings.
