The criminal trespass won't hold water.  She let him in........twice (if you know what I mean).  He should be charged with adultery.  Is that even a PL charge in NY ?

It's a PL misdemeanor but no DA in NY has ever charged anyone with it. We're directed not to enforce it. I suspect it's solely on the books for divorce court judges to hold somebody responsible for during civil proceedings. 

maybe the wife and sarge told him to leave and he refused? then crim trespass.........

Seems to me like the off-duty was attempting an arrest when the perp raised a weapon
