Following receipt of your request searches were conducted within the MPS to locate information relevant to your request.

DECISION

Pursuant to the provisions of Section 21 of the Freedom of Information Act 2000 (the Act) I have decided to refuse access to the information you have requested.

REASON FOR DECISION

Section 21 of the Act provides:

(1)        Information which is reasonably accessible to the application otherwise than under section 1 is exempt information…
(3)        For the purposes of subsection (1), information which is held by a public authority and does not fall within subsection (2)(B) is not to be regarded as reasonably accessible to the applicant merely because the information is available from the public authority itself on request, unless the information is made available in accordance with the authority’s publication scheme and any payment required is specified in, or determined in accordance with, the scheme.

Don't bother downloading the PDF, it's about rolling stock. I am resending the request, insisting that MPS do hold the information

Dear Sir,

Thanks you for your speedy reply.

Unfortunately, the PDF file you mentioned does not contained the
information I requested.

The information I seek is the following.

What were the train numbers, actual arrival times and actual departure
times of westbound services through King's Cross-St Pancras on the
Piccadilly Line on 7 July 2005 between 08.30 and 09.15?

TfL have informed me that The Metropolitan Police Service holds this
information (TfL FOIA request reference 1906601).

I write in connection with your request for information which was received by the Metropolitan Police Service (MPS) on 03/08/2007.  I note you seek access to the following information:

    * I request the CCTV recordings from the no. 30 bus on which a bomb exploded on 7th July 2005 for the period of time between 0925 and 0946.


Following receipt of your request searches were conducted within the MPS to locate information relevant to your request.

DECISION

I have today decided that access cannot be provided to the information you have requested as it is not held by the MPS.

As has previously been widely reported, the CCTV equipment on the bus you refer was not operating. Therefore there are no CCTV recordings to meet your request.

I add these points simply by way of additional information given the importance of the material you request.

If such material existed, it would undoubtably have been highly significant to the investigation into the events of that morning. Its existence would inevitably have been made public, especially to the close relatives of those who were killed, and the surviving victims of that attack. As you must appreciate, had there been CCTV footage of that journey, potentially it would have shown the last horrific moments of many people. The publication of that sort of image is out of the question. Had it existed, its content would have been exempted from release under numerous sections of the Freedom of Information Act. However, as I have said, the CCTV equipment on that bus was not operating.

COMPLAINT RIGHTS

Your attention is drawn to the attached sheet which details your right of complaint.

Would the last service report for the CCTV on the bus be made available under FOI?

No -- private companies.

Maybe I should ask the Met for info on why the CCTV was not operating.
