"The Castillo conviction was for the sale of an adult manga to an adult... In the original case, the prosecution argued that comics are a children's medium, and that the medium and the proximity of the store to a school meant that the adult material was meant to appeal to children. This was undoubtedly an essential component for obtaining a conviction, since adult Pay Per View channels and hardcore magazines are ubiquitous in almost all U.S. jurisdictions."

Anyway, its a simple double standard. Because "comics" (like video games) are for "kids" (despite most studies showing the opposite), they're alowed to be censored like that, despite the fact that they DID follow the law. I feel sorry for Jesus, who's only "crime" was selling adult material to...AN ADULT!
The article mentions that his only chance is to have this heard by the Supreme Court, which can go either way and most likely will never happen. If he were to win such a case with the SC, perhaps that'll reinforce their earlier ruling (which barely passed BTW) regarding drawn/rendered pornography. Then again, I'm sure Ashcroft will try and get something stupid declared, possibly making manga or comic book artists "terrorists".
EDIT: Hm, I guess you'll want to leave your vast collection of hentai manga in the UK Katy. Texas just doesn't seem like the place for you to get your fill of perverted obsessions.

I havent read the article, but how the hell are they holding the comic censory code up against manga? They are two different types of publications... unless the CCC also included nickle books... but I thought the code came in after those stopped being made...
Bleh.. maybe I should go read the article huh.. chee

Followup just now, thanks to the slug pace of legislation.
Quote:
The State prosecutor did not offer contradictory testimony, but secured a guilty verdict with a closing argument stating, I dont care what type of evidence or what type of testimony is out there, use your rationality, use your common sense. Comic books, traditionally what we think of, are for kids. This is in a store directly across from an elementary school and it is put in a medium, in a forum, to directly appeal to kids. That is why we are here, ladies and gentlemen. Were here to get this off the shelf. Castillo was found guilty and sentenced to 180 days in jail, a year probation, and a $4,000 fine.
